Council of the Republic adopted the Republican Budget for 2012

      On 20 December 2011 the regular sitting of the seventh session of the Council of the Republic of the National Assembly of the Republic of Belarus took place.
      The discussion of the agenda items was opened with the draft Laws regulating the economy sphere.
      The parliamentarians approved the draft Law of the Republic of Belarus On Amending the Tax Code of the Republic of Belarus which ensures further simplification of the tax system of the country, the specific tax calculation and payment. The draft Law adoption will allow to reduce economy tax burden for 0.46% to gross domestic product (GDP). The Directive of the President of the Republic of Belarus 4 of 31 December 2010 and programs aimed at the economic relations liberalization underlie the draft Law.
      The draft Law of the Republic of Belarus On the Budget of the State Extra-Budgetary Social Protection Fund for 2012 presupposes that the budget fund income will make up to RUB 47,550.9 billion, and 77.9% of the whole expenditures will be directed at the pension supply of the people, the rest means mainly at the allowance payment.
      In accordance with the draft Law of the Republic of Belarus On the Republican Budget for 2012 the budget policy for 2012 will be aimed at supplying the macro finance balance, implementation of the State guaranteed obligations and achievement of the finance security parameters, therefore the republican budget income and expenditure are projected at the rate of RUB 92.77 trillion at the debt-neutral basis.  Next year non-priority expenditures are planned to be reduced, while the budget service quality and social protection of the vulnerable groups of society will be preserved. The state programs crediting is going to be carried in the amount imposing no risks on the macro finance stability.  
      The parliamentarians approved several draft Laws aimed at improving the criminal procedural and civil procedural legislation, as well as establishing the advanced advocacy system.
      The provisions of the draft Law of the Republic of Belarus On Amending the Criminal Procedure Code of the Republic of Belarus on the Cassational Procedure Issues are aimed at improving the efficiency of the  control of legality, reasonableness and review of the judgements and other judicial decisions on criminal cases which have not entered into legal force. To this end new specific appeal components are introduced in the criminal proceeding, i.e. court of cassation is lodged with some additional powers, inclusive of moving into the judgement changes which can either mitigate or aggravate the accused state, under the unamended right of the accused of defense. Such approach will facilitate immediate identification of possible miscarriages of justice by the court of general trial and elimination of errors without judicial review. 
      The draft Law of the Republic of Belarus On Amending certain Laws of the Republic of Belarus is aimed to correct the provisions of the Code of Civil Procedure of the Republic of Belarus. In particular, it considers the possibility of case consideration in trial in absentia, particulars of administering complaints both by convicted to arrest, confinement, life imprisonment, the ones kept in custody for being penalized and by administratively arrested for being disciplinary penalized.  
      The draft Law of the Republic of Belarus On Advocacy in the Republic of Belarus first introduces new advocacy institutions such as law bureau and individual advocacy. They will constitute the advocacy system basis along with legal advice. The draft Law of the Republic of Belarus expands the legal aid types, the bar have right to provide. The list of information constituting the legal professional privilege subject is specified.
      The draft Law of the Republic of Belarus On Amending the Law of the Republic of Belarus On Public Service in the Republic of Belarus provides for the prohibition to receive from the foreign states the documents granting right to benefits and privileges due to political, religious views or national identity and to use such benefits and privileges. It will enable to eliminate the clash of interests when doing the civil service.
      The parliamentarians considered and approved the draft Laws of the Republic of Belarus worked out purposely to improve existing legislation in the healthcare sphere.
      The draft Law of the Republic of Belarus On Sanitary and Epidemiological Welfare of the Population establishes the rights and responsibilities of the citizens, organizations and individual entrepreneurs in this field. In particular, it presupposes that new production technologies are not allowed to be introduced until approved by the institutions and bodies in charge of the state sanitary supervision. The order of sanitary-hygienic expertise conduct, goods state registration, social-hygienic monitoring, etc is specified. 
      The draft Law of the Republic of Belarus On Delimitation of  Diseases Posing Health Hazard to the Population and Human Immunodeficiency Virus (HIV) determines legal and organizational basis of prevention of extension of diseases posing health hazard to the population and HIV. It provides for the preventive control complex aimed at incidence delimitation, early detection and prevention of illness. It introduces provisions on compulsory medical examination, hospitalization and treatment of the persons reasonably supposed to have socially dangerous disease and HIV.     
      The draft Law of the Republic of Belarus On Mental Health Services is targeted to improve legal management of the social relations concerning mental health services provision, as well as protection of rights and legal interests of both patients and medical professionals. Presumption of not having mental aberration is first recognized at the legislative level. The draft Law of the Republic of Belarus contains provisions on state management and state policy in the field of mental health services provision, state guarantees to the persons affected by mental aberration. 
      The draft Law of the Republic of Belarus On Assisted Reproductive Technologies determines legal and organizational basis of the above technologies application. It contains provisions regulating donorship of germ cells, their storage and use. The rights of patients when applying such technologies are legally codified. It provides for prohibition against embryo usage in science and research goals. Terms and procedure of extracorporal fertilization, surrogacy and artificial insemination appliance are determined. Requirements for the surrogate mothers to meet, as well as their rights and responsibilities are first established.
      The draft Law of the Republic of Belarus On Counteracting Human Trafficking determines procedural and institutional basis in the sphere and establishes a complex of measures on protection and rehabilitation of victims of such crimes with regard to the international recommendations, inclusive of the CIS model legislation.
      The parliamentarians ratified the following international legal documents:
      The Agreement between the Government of the Republic of Belarus and the Government of the Russian Federation on Cooperation in Exploration and Peaceful Uses of Outer Space;
      Protocol on Amending the Statute of the Court of the Eurasian Economic Community of 5 July 2010;
      Agreement on the Rules for Determining the Country of Origin of Goods in the Commonwealth of Independent States;
      Agreement on Eurasian group Counter-acting Legalization of Proceeds from Crime and Terrorist Financing;
      Agreement between the Government of the Republic of Belarus and the Government of the People's Republic of China on the Chinese-Belarusian Industrial Park.
      Moreover the parliamentarians considered other issues of the agenda.
      Before the sitting Chairperson of the Standing Committee of the Council of the Republic for Economy, Budget and Finances Mr Vadim Popov answered the questions of the representatives of the information agency BelTA, the first channel of the Belarusian Radio and state TV and radio companies. He commented on the main provisions of the draft Laws On Amending the Tax Code of the Republic of Belarus and On the Republican Budget for 2012.
